We are particularly excited to host you in Ljubljana as we will be celebrating the sixtieth anniversary of the 1958 New York Convention as well as the ninetieth anniversary of the Ljubljana Arbitration Centre! We have prepared an exciting programme to mark the happy occasion. This year the focus will be on:
- Recent trends in the application of the New York Convention,
- Role of arbitral tribunals in combatting economic crime in international arbitration,
- Third party funding in international arbitration – reshaping the landscape of dispute resolution.
The 1958 New York Convention has decisively contributed to the widespread use of international arbitration since its adoption sixty years ago. It enables parties to seek recognition and enforcement of foreign arbitral awards in 157 member States. A first panel will review the recent trends and developments in the application of the Convention in select jurisdictions (Slovenia, Croatia, Serbia, Switzerland, Austria and Hungary). Practitioners from the region will share the relevant procedure and practice in enforcing foreign arbitral awards in their countries.
In a world of increased transparency, good governance and compliance regulations, arbitral tribunals are increasingly coming across potential illegal activities of the parties. Money laundering, corruption and bid-rigging are frequently masked under seemingly legitimate contracts and disputes arising from those contracts may end up in arbitration. We will discuss common red flags signalizing illicit activities, the role of arbitral tribunals and propose solutions aimed at combatting economic crime.
In light of the upcoming report of the ICCA-Queen Mary Task Force on Third-Party Funding in International Arbitration, we have prepared a stimulating afternoon session on the current developments on third-party funding. The roundtable will provide a 360 degree scrutiny of intricate issues of on third-party funding and consider whether and how principles of best practice can evolve in the industry.
