Why do businesses in Macedonia decide (not) to use arbitration?

Contrary to the long accepted premise that arbitration is the ordinary method of settling international disputes, more and more often concerns are being voiced that arbitration costs just as much and takes just as long as state court litigation, leading many authors to suggest that there is a “flight from arbitration”. When it comes to countries that do not have developed arbitration practice, such as Macedonia, it is questionable how often business users pose the question – to arbitrate or not? The authors provide an insight on the situation with arbitration in Macedonia and the reasons businesses decide (not) to submit their disputes to arbitration, as well as the perspectives for encouraging them to use arbitration.
